1. Acceptance of Terms

By downloading, installing, or using the Tailored Tip mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legal agreement between you and Sassy Dog LLC ("Company," "we," "our," or "us").

2. Description of Service

Tailored Tip is a tip calculation and bill-splitting application available for iOS and Android devices. The App provides tools for calculating gratuities, splitting bills among multiple parties, scanning receipts, and managing tipping preferences. The App is provided "as is" and "as available" for your personal, non-commercial use.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on devices you own or control
  • Use the App for your personal, non-commercial purposes
  • Access and use the features provided by the App

This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

4. Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Copy, reproduce, or redistribute the App or its content
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any portion of the App
  • Remove, circumvent, or disable any proprietary notices or labels
  • Use the App in any way that could damage, disable, or impair the service
  • Use any robot, spider, or other automated device to access the App
  • Sell, rent, lease, or sublicense the App to third parties

5. In-App Purchases

The App offers in-app purchases, including:

  • Ad Removal: A one-time purchase to remove advertisements
  • Premium Features: Additional functionality and customization options

All in-app purchases are processed through the Apple App Store or Google Play Store. Purchases are final and non-refundable, except as required by law or the respective store's policies. You are responsible for all charges incurred through your account.

6. User Content and Conduct

While the App primarily stores data locally on your device, you are responsible for your use of the App and any content you create or process through it. You agree to use the App only for lawful purposes and in accordance with these Terms.

7. Intellectual Property

The App and its original content, features, and functionality are owned by Sassy Dog LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not guarantee the accuracy of tip calculations or bill splits. Users should verify all calculations independently. The App is a tool to assist with calculations and should not be solely relied upon for financial decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SASSY DOG LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sassy Dog LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

13. Changes to Terms

We may revise these Terms at any time by updating this page. By continuing to use the App after such revisions are in effect, you agree to be bound by the revised Terms. We encourage you to review the Terms periodically.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sassy Dog LLC regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.
